This will happen with my ex husband ... He was in a grocery parking lot in the car of his mother. She had no insurance on the car. He was parked in a space, but sitting in the car. Although he was not driving at the time it is logical that his car had to get there somehow so that the police gave him a ticket. This has always seems so bad for me because not only does not move (the car was not ) he did not hit anyone , the other person did.
Anyway, you have to have a police report anyway to file an insurance claim , so if you have one and not get into trouble and then I say go ahead and file against their insurance. If the other person's fault then it is your coinsurance. responsibility to pay for the damage.
