Is a License, insurance etc required for an 80cc (35-40mph) motor assisted bicycle?

All Craigs List ads seem to say " under 50cc without insurance license is required, the record! " but I thought that guy selling a bike that he says he has a 80cc engine in it that goes from 35 ... 40 mph but still just a bike, and people who ride your bike on the bike path , are not required to be licensed, etc. , so if you only on the bike path is a legal requirement. And then it would be necessary if the car was in traffic ... I've seen motorcycle engines not even that. Thanks anyone for any information :)

If you have an engine and runs on a path that actually have to be licensed and insured .
