Is the person back .
You are driving through the parking lot and a driver is back and comes to you at fault because they should not excavated and did not back down unless you gave them the signal .

I think it's the law, the person who hits you , it's your fault. Becuase like, even if you suddenly stopped and rear ended , blame was the person who has beaten.

Being the driver of a small car ... I think when my view is blocked on both sides by large vehicles like SUV , the " traffic" lane of the parking area should drive defensively and do it. Fault must be determined on the basis of the circumstances , for example: When backing that I can not see what's coming to my point of view is clear and sometimes you get a flying car blowing horns and screeching breaks . On the other hand I have had the opposite happen in the car parked right is removed regardless of the vehicle in the " traffic" lanes. Finally, I had a single accident in high school parking lot where they both supported each other. The judge ruled in favor of me as the other vehicle was in my blind spot and is based on the damage to my car that had begun to support first.

The most important thing is that both drivers should take precautions in any case , such as pedestrians or children could be thrown into traffic or behind a parked car just the same as a vehicle.

Not much of an answer, but it's my 2 cents .

Depends on the laws in your state, in my state of its responsibility as to avoid the accident and the person who made it out of a parking zone . More or less they had obtained the violation?

It is much the fault of the parties, not to give out the back of cars and another for improper backing . I do not know any police officer can legally write an entry for this clash . Usually by the insurance company . However, as reported to the police (necessary for certain amounts of damage ) and not admit guilt . Rule: Do not back up anyone to stop waiting for you! And if you're going , do not expect anyone to have , backup lights, or wait until you get through, or see that due to blind spots. Sometimes there are more than in a big hurry and do not care !

It's his fault , but the parking lots are private property so the police can not enforce it. MedlinePlus MedlinePlus you would have to get the amount to claim manger whos fault it was ( or one of his security guards )
