Assuming it is your insurance company or other company has inspected the vehicle to obtain measurements , tests of paint transfer , "match- up" of damages , etc., and assuming no independent witnesses who saw the accident would have no choice but to take the truck owner to small claims court . You may file a complaint through its insurance division of the states, but not usually have the authority to decide liability. In fact , unless you are filing a complaint against his own carrier, the division can do very little for you. I check with the insurance company to see what type of research conducted. If you've never looked at his vehicle, for example, or photos do not measure , you can bet that almost made a sloppy investigation . Note, however, that the other company will protect the interests of its insured. If there is no evidence that the vehicle was struck by the owner of the SUV , the other company would have no choice but to deny responsibility.
